FucaSpark is a service of RP Digital LLC. Your order is placed with, and your contract is with, RP Digital LLC.
1. Sites you may submit
You may submit a site for scanning or quoting only if you own it or are authorised to act for its owner. Submitting a site you do not control is a breach of these terms, and we may refuse or reverse any quote or order arising from one.
2. What we deliver
An order states what it covers: the number of pages to be marked up, the form the markup is delivered in, and that every entity and fact carries a content hash. Your visible text is not altered.
Delivery includes a validation report listing every page delivered and the markup added to it. Where a page in your order is not delivered, or is delivered carrying no markup, section 6 applies.
3. Rights in the markup
You grant RP Digital LLC the right to fetch, read and process the pages you submit for the purpose of performing your order.
The AODM markup produced under your order — the tags, their identifiers, types, relationships, confidence values and content hashes — is the work product of RP Digital LLC, which owns it and all rights in it, together with the record of the address it was produced for.
You receive a perpetual, irrevocable, worldwide, royalty-free licence to use, modify and publish that markup on the site it was produced for. No further fee is due for that use.
Use of your markup beyond your own order — combining it with markup made for other sites into a knowledge graph, dataset or other derived work — happens only where you gave that permission separately at checkout. It is a distinct tick box, it is optional, and an order placed without it is performed on the same terms and at the same price. Where it is given, RP Digital LLC may use, combine, publish and licence the markup and its address record on that basis, without further payment. What is kept is the markup and the address it was produced for. Your page text is not read into it and not held in it.
Withdraw that permission by writing to Support@FucaSpark.com and your markup is removed from the graph. Copies already licensed to a third party before you wrote are not recalled.
Your pages remain yours. Nothing here transfers ownership of your content.
4. Prices
A quote is fixed for the order it was issued for. Prices for future orders and for renewals may change at any time, and we will tell you before a renewal is charged at a new price.
Support subscriptions are billed a year at a time. There is no multi-year price and no multi-year commitment in either direction: you may cancel before any renewal, and we may reprice at any renewal.
Where a new version of the AODM specification requires existing markup to be reworked, that rework is included for subscribers for the specification version current when your subscription year began. Rework required by a later version is quoted separately or covered by a renewal at the price then in force.
5. Delivery
We may decline to perform an order at any time before work begins on it. Where we do, we refund it in full, and that refund is the whole of our liability for an order not performed.
6. Refunds
Set out in full on the refunds page, which forms part of these terms.
Before processing begins on your order, you may cancel it for any reason and be refunded in full.
Once processing is complete, the order is not refundable. The work is made to order and the cost of making it is spent when it is made. Where the validation report does not meet the numbers stated on your order, we correct those pages at no charge; that correction is your remedy in place of a refund.
7. Acceptable use
You may not use the service to mark up content that is unlawful, that you have no right to publish, or that you have no right to have processed.
8. Liability
We are liable to you for no more than the amount you paid for the order the claim relates to. Nothing here limits liability that cannot be limited by law.
9. Changes to these terms
These terms carry a version. The version you agreed to is recorded with your order and governs it. A changed version applies to orders placed after it is published.
